These Terms & Conditions (“Terms”) govern your use of the website, online store, membership programs, event registrations, SMS communications, and services provided by:

By accessing or using our services, you agree to these Terms.
1. Age Restriction (21+)
Karma Cigar Bar sells tobacco products only to individuals 21 years of age or older.
By purchasing from us, you represent and warrant that:
You are at least 21 years old.
You are legally permitted to purchase tobacco products.
You are legally permitted to receive shipments of tobacco products within Indiana.
We reserve the right to cancel any order if age verification cannot be completed.
2. Account Responsibility
If you create an account:
You are responsible for maintaining account confidentiality.
You are responsible for all activity under your account.
You agree to provide accurate and current information.
We reserve the right to suspend or terminate accounts that violate these Terms.
3. Product Availability & Pricing
All prices are listed in U.S. Dollars.
We reserve the right to:
Modify pricing at any time.
Correct pricing or typographical errors.
Cancel orders resulting from pricing, inventory, or system errors.
Product availability is not guaranteed until payment is successfully processed.
4. Indiana Shipping Policy
Tobacco products are shipped only within the State of Indiana.
Delivery times are estimates and not guaranteed.
We do not ship tobacco products outside Indiana.
5. Shipping & Risk of Loss
All shipments are FOB Merrillville, Indiana.
Title and risk of loss transfer to the purchaser upon shipment.
Karma Cigar Bar is not responsible for carrier delays, theft, damage, or loss once the shipment has been transferred to the carrier.
Adult signature (21+) may be required upon delivery.
6. Returns & Refunds
Due to the nature of tobacco products, all cigar and tobacco sales are final.
Replacement may be issued only if:
Items arrive damaged, or
Incorrect products are shipped.
Claims must be reported within 48 hours of delivery.
Non-tobacco merchandise may be eligible for return within 14 days if unused and in original packaging.
Shipping charges are non-refundable unless the error was ours.
7. Backorders
Backordered items will not be charged until ready to ship.
If a product becomes unavailable, customers may cancel or substitute.
8. Event Policies
Event tickets are non-refundable unless the event is canceled by Karma Cigar Bar.
Tickets may be transferable only with prior approval.
We reserve the right to:
Refuse entry to intoxicated or disruptive individuals.
Remove guests violating house policies.
9. Membership Terms
Membership benefits (including VIP, Executive, and Corporate tiers) are privileges and not contractual rights.
Membership benefits are subject to availability and modification.
Membership fees are non-refundable unless otherwise stated in writing.
We reserve the right to suspend or revoke membership privileges for:
Policy violations
Disruptive behavior
Illegal conduct
10. Alcohol Policy
Alcohol is served in compliance with Indiana law.
We reserve the right to refuse alcohol service to any individual who appears intoxicated or disruptive.
Guests must comply with all applicable alcohol regulations.
11. SMS & Electronic Communications
By providing your mobile number and affirmatively opting in, you consent to receive SMS communications from Karma Cigar Bar related to:
Reservations
Event notifications
Membership updates
Order confirmations
Customer service communications
Message frequency varies. Message and data rates may apply.
Consent to receive SMS messages is not a condition of purchase.
We do not use purchased lists or third-party lead databases.
Mobile numbers and SMS consent data are not sold or shared with third parties for marketing purposes.
To opt out at any time, reply STOP.

12. Website Use
You agree not to:
Use the website for unlawful purposes.
Attempt unauthorized access to systems.
Interfere with website functionality.
We reserve the right to suspend or restrict access for misuse.
13. Intellectual Property
All website content, branding, logos, graphics, text, and materials are the property of Karma Cigar Bar and may not be reproduced without written permission.
14. Disclaimer of Warranties
All products and services are provided “as is” and “as available.”
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.
15. Limitation of Liability
To the fullest extent permitted by law:
Karma Cigar Bar shall not be liable for indirect, incidental, consequential, or punitive damages, including lost profits.
Total liability for any claim shall not exceed the amount paid for the product or service at issue.
16. Indemnification
You agree to indemnify and hold harmless Karma Cigar Bar from any claims arising from:
Misuse of products
Violation of these Terms
Illegal resale or distribution
17. Tobacco Regulatory Compliance
Karma Cigar Bar complies with all applicable federal, state, and local tobacco regulations.
Purchasers agree they:
Are legally permitted to purchase and possess tobacco products.
Will not resell tobacco products in violation of applicable laws.
Are responsible for lawful transportation and possession.
18. Pergola & Outdoor Reservation Policy
Outdoor and pergola reservations are subject to availability, weather conditions, and operational discretion.
By reserving outdoor space, you acknowledge:
Weather and temperature conditions are outside of our control.
Heated service may be unavailable below safe operating temperatures.
Minimum spending requirements may apply.
Deposits, if required, are non-refundable unless canceled by Karma Cigar Bar.
We reserve the right to modify or cancel outdoor reservations due to safety concerns.
19. Arbitration & Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms, purchases, memberships, reservations, events, or services shall be resolved through binding arbitration rather than in court, except where prohibited by law.
Arbitration shall:
Be conducted in Lake County, Indiana
Be resolved by a single arbitrator
Be administered by a mutually agreed arbitration provider
By agreeing to these Terms, you waive the right to a jury trial and participation in any class action lawsuit.
Each party shall bear its own legal costs unless otherwise determined by the arbitrator.
Nothing in this section prevents either party from seeking injunctive relief where appropriate.
20. Governing Law
These Terms shall be governed by the laws of the State of Indiana.
21. Privacy
Your use of our services is subject to our Privacy Policy.
22. Changes to Terms
We reserve the right to modify these Terms at any time.
Continued use of our services after updates constitutes acceptance of the revised Terms.
